The Court Annulled the Migration Department’s Decision Refusing to Review Deportation After Childbirth

On 24 November 2024, a foreigner requested the Migration Department to reconsider his deportation and entry ban, as the 26 October 2021 decision had not been enforced for three years; his son, a Lithuanian citizen, was born in 2024. The Migration Department partially granted the request on 14 April 2025, shortening the entry ban to three months. The applicant challenged this in court.
On 16 June 2025, Regional Administrative Court in case No. eI2-11945-872/2025 annulled the decision and ordered reconsideration, noting that the department failed to adequately assess family ties and the best interests of the children. The department appealed, but the Supreme Administrative Court rejected the appeal on 6 August 2025 (administrative case No. eA-2352-520/2025).
